These Terms form a binding agreement between Constructie Lambrecht NV and the professional user of SiloMatch. If your employer or another organisation has arranged access, that organisation may also have a separate agreement with us. If you do not agree, do not use the App.

1. Who we are and what these Terms cover

SiloMatch is provided by Constructie Lambrecht NV (“Lambrecht”, “we”, “us” or “our”), enterprise and VAT number BE 0407.821.256, with registered office at Hoogledestraat 122, 8610 Kortemark, Belgium.

These Terms govern access to and use of the SiloMatch mobile application, its related services, updates, documentation and support channels (together, the “App”). Our Privacy Policy explains how personal data is handled and forms part of the information made available with these Terms.

If a signed customer agreement, order form, service-level agreement or data processing agreement conflicts with these Terms, that document takes priority for the subject it covers. Mandatory law always prevails.

2. Intended professional use

SiloMatch assists trained professional users during the transfer of dry bulk animal-feed products from a truck or trailer to a farmer’s silo. Using computer vision, the App photographs the coupling, assesses whether a valid coupling is visible and reads the silo number from the label. It then presents what it read for you to confirm.

The App proposes; you decide. A silo number you type yourself always takes precedence over one the App read, and only the number you confirm proceeds. Confirming also stores the photograph and what the App read, which Lambrecht uses to improve the recognition models — see the Privacy Policy. This collection is part of how the App works and cannot be switched off.

The App authorises nothing. It does not communicate with the trailer, the silo controller or any other equipment, it does not start, permit or stop a transfer, and it does not verify that a connection is mechanically secure, leak-free, correctly labelled, unobstructed, compatible with the product or safe to use. It does not check product identity, silo capacity, valve position, grounding, pressure, contamination risk or compliance with site procedures. A result is information for a trained operator and nothing more.

3. Eligibility and authority

  • You must be at least 18 years old and legally capable of accepting these Terms.

  • You must use the App only in a professional capacity and be authorised by the organisation that assigned or approved your account.

  • You must have the training, licences, protective equipment and authority required for the vehicle, site and transfer operation.

  • If you accept these Terms for an organisation, you confirm that you have authority to bind that organisation where applicable.

4. Account access and security

SiloMatch has no user accounts. The App signs each device in automatically and anonymously; there is no username, no password and no personal profile. Access therefore travels with the device rather than with you.

You must use the App only on a device issued or approved for that purpose by the organisation that authorised you, keep that device secure, and promptly tell your organisation or us if it is lost, or if you suspect misuse or unauthorised access. Anyone holding the device can produce records in its name, so treat it as you would a signed delivery note.

We may suspend or withdraw access where reasonably necessary to protect safety, security, the App, other users or legal compliance.

5. Camera access and vision analysis

The core function requires camera access. Activate the camera only when it is safe and lawful to do so. Frame the equipment as instructed, avoid capturing people or unrelated property, and do not use the App while driving or while operating equipment in a way that requires your full attention.

Vision detection can be affected by lighting, weather, dirt, occlusion, equipment variations, camera quality, movement, connectivity, software defects and unfamiliar configurations. False matches and false non-matches may occur. You must treat low-confidence, unclear, unavailable or inconsistent results as a failed check and stop until the connection is independently verified.

6. Mandatory safety responsibilities

No automatic permission to unload

Never start or continue loading or unloading solely because SiloMatch displays a positive result. The authorised operator remains responsible for completing all required physical, documentary and site-specific checks.

  1. Park, secure and isolate the vehicle and equipment as required by law, training and site rules.

  2. Verify the delivery, product, customer, silo identification, available capacity and connection point using the applicable documents and site markings.

  3. Physically confirm that the hose or tube is correctly seated, secured and suitable, and that valves, seals, pressure controls and safety systems are correctly configured.

  4. Stop immediately if the App result conflicts with your observation, another system, a site instruction or any safety indicator.

  5. Report suspected misclassification, unsafe conditions, damage, contamination, spills and incidents through your organisation’s required channels.

7. Acceptable use

You may use the App only for its intended professional purpose, in compliance with applicable law, customer instructions and these Terms. You must not:

  • bypass safety controls, warnings, permissions, authentication, rate limits or technical restrictions;

  • use another person’s account, create false records or manipulate images, results, identifiers or audit trails;

  • upload unlawful material or images you are not entitled to capture or submit;

  • attempt to derive source code, models, model weights, training data or non-public interfaces, except where mandatory law expressly permits it;

  • probe, scan, disrupt or overload the App or introduce malware or harmful code;

  • use outputs to train or benchmark a competing vision model without our written consent;

  • use the App for surveillance, facial recognition, biometric identification, employee evaluation outside the disclosed operational purpose, or any unlawful discriminatory purpose; or

  • use the App while driving, in a hazardous area contrary to equipment certification, or where mobile devices are prohibited.

8. Your content and operational records

You or your organisation may provide photographs, equipment identifiers, confirmed silo numbers, comments, support material and other data (“User Data”). You retain your rights in User Data. You grant us a non-exclusive, royalty-free right to host, process, reproduce and transmit User Data in order to provide, secure and support the App, to train and evaluate the recognition models used in it, and to comply with law.

You confirm that you and your organisation have a lawful basis and all necessary notices, permissions and rights for User Data, including photographs that may incidentally contain individuals, vehicle registration plates, property or customer information. Do not submit special-category personal data, confidential information unrelated to the operation, or images of people unless strictly necessary and lawfully authorised.

Lambrecht is the controller for the personal data the App sends to it, as described in the Privacy Policy. SiloMatch holds no workforce or delivery records on behalf of your organisation.

9. Licence and intellectual property

Subject to these Terms and any customer agreement, we grant you a limited, revocable, non-exclusive, non-transferable and non-sublicensable licence to install and use the App on approved devices for internal professional purposes. All other rights are reserved.

The App, software, vision models, interfaces, designs, documentation, trademarks and related intellectual property are owned by or licensed to Lambrecht. Open-source components remain subject to their own licences. Feedback may be used by us without restriction or payment, provided we do not identify you publicly without permission.

10. Third-party services and app stores

The App may depend on operating-system providers, app stores, hosting, identity, notification, mapping, support or other third-party services. Their own terms and privacy practices may apply. Availability may be affected by third parties outside our control.

Apple and Google are not parties to these Terms and are not responsible for the App, support, maintenance or claims relating to it, except to the extent required by their applicable store terms. If store terms conflict with these Terms, the store terms control only as necessary for use through that store.

11. Updates, availability and support

We may update the App to improve performance, security, compatibility or functionality. Some updates may be required for continued use. We may modify or discontinue features where reasonably necessary, subject to any customer agreement and applicable law.

Unless a service level is agreed in writing, the App is provided on an “as available” basis. Maintenance, connectivity, device limitations, cyber incidents and events beyond reasonable control may cause interruptions. Support is available through the contact details in section 18.

12. Accuracy and disclaimers

We use reasonable care in developing and operating SiloMatch, but computer-vision results are probabilistic and may be incomplete, delayed or wrong. To the fullest extent permitted by law, we do not warrant uninterrupted or error-free operation, detection of every incorrect connection, compatibility with every device or equipment configuration, or fitness for a purpose not expressly agreed in writing.

Nothing in these Terms excludes statutory warranties or other rights that cannot lawfully be excluded.

13. Liability

Each party remains liable for loss caused by its own fraud, wilful misconduct or liability that cannot be limited under applicable law. Nothing in these Terms limits liability for death or personal injury to the extent caused by a party and not lawfully excludable.

Subject to the paragraph above and any different limit in a signed customer agreement, Lambrecht is not liable for indirect or consequential loss, loss of profit, revenue, production, contracts, goodwill or data, product contamination, misdelivery, business interruption, or the cost of substitute services, except where such exclusion is prohibited by law.

Subject to the same exceptions, Lambrecht’s aggregate liability arising from the App in any twelve-month period is limited to the fees paid or payable by the relevant customer for SiloMatch during that period. If no fee was paid, the cap is EUR 1,000. This limitation applies only to the extent permitted by Belgian law and does not reduce any higher mandatory entitlement.

14. Indemnity by business customers

To the extent permitted by law, the organisation responsible for an account will indemnify Lambrecht against third-party claims arising from its unlawful User Data, unauthorised use, breach of these Terms, violation of another person’s rights, or failure to comply with mandatory operating and safety procedures, except to the extent the claim was caused by Lambrecht.

15. Suspension and termination

You may stop using the App at any time. There is no account to close: uninstalling the App removes the anonymous session from the device. Records already sent to Lambrecht are kept and deleted on the schedule in the Privacy Policy.

We may withdraw access for material breach, safety or security risk, unlawful use, customer instruction, discontinuation of the service or as required by law. Where practical, we will give notice and an opportunity to remedy.

On termination the licence ends and you must stop using the App. Provisions intended by their nature to survive — including intellectual property, liability, confidentiality, dispute and data provisions — continue to apply.

16. Changes to these Terms

We may revise these Terms for legal, security, technical or service changes. We will display the updated date and provide reasonable advance notice of material changes through the App or through the organisation that issued your device, unless an urgent change is required. Continued use after the effective date constitutes acceptance where permitted by law. If you do not agree, stop using the App and return the device to the organisation that issued it.

17. General provisions

Neither party waives a right by delaying its exercise. If a provision is unenforceable, it will be limited or removed only to the minimum extent necessary and the remaining provisions stay effective. You may not assign your rights without our consent; we may assign these Terms as part of a merger, reorganisation, financing or transfer of the relevant business, subject to applicable law. These Terms and referenced documents constitute the agreement on App use, without affecting a separate signed customer agreement.

English is the working language of this draft. If official translations are published, the version identified as controlling in the applicable customer agreement will govern, subject to mandatory law.

18. Governing law, disputes and contact

These Terms are governed by Belgian law. The courts of the judicial district of West Flanders have exclusive jurisdiction, except where mandatory law requires another forum. Before filing proceedings, the parties should first try in good faith to resolve the dispute through the customer and support contacts.
